Terms of Service

1. The service

Bossa Ventures LLC designs, develops and operates its own consumer mobile and web applications. Each application is distributed under its own brand, published on the Apple App Store, Google Play or the web, and sold to consumers by subscription. Our published applications currently include Petal: 75 Day Challenge. An application may publish supplementary terms specific to it; where those conflict with these terms, the supplementary terms govern for that application.

We do not develop software for third parties and we do not provide consulting services. Nothing on this website is an offer of professional services.

2. Eligibility and accounts

You must be at least 13 years old, or older where local law sets a higher minimum age, and you must have the legal capacity to enter into this agreement. You are responsible for the accuracy of the information in your account and for keeping your credentials confidential. Tell us at support@bossa-ventures.com if you believe your account has been used without your authorisation.

3. Subscriptions and billing

Purchase

Paid features are sold as recurring subscriptions. The price, billing period and features of each plan are shown before purchase, inside the application or on the product's own website. Applicable taxes are added where required.

Automatic renewal

Subscriptions renew automatically at the end of each billing period at the then-current price, unless cancelled at least 24 hours before the period ends. We will tell you in advance of any price change and you may cancel before it takes effect.

Where you bought it

Subscriptions purchased through the Apple App Store or Google Play are billed by Apple or Google and are managed in your store account. Subscriptions purchased on a product website are billed by our payment processor. We do not store card numbers.

Cancellation and refunds

You may cancel at any time. Cancellation stops future renewals; access continues until the end of the paid period. Refunds for store purchases follow Apple's or Google's refund policies, which we cannot override. For purchases made on a product website, write to billing@bossa-ventures.com within 14 days of the charge and we will review the request. Statutory withdrawal rights, where they apply to you, are unaffected.

Free trials

Where a free trial is offered, its length and terms are shown at sign-up. A trial converts to a paid subscription at the end of the trial period unless cancelled before it ends.

4. Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable licence to use our applications for your own non-commercial purposes, subject to these terms. You may not:

• copy, modify, reverse engineer, decompile or create derivative works of the applications, except where the law expressly permits it;
• resell, sublicense, rent or share paid access with people outside your household;
• circumvent access controls, rate limits, licence checks or payment mechanisms;
• use the applications for anything unlawful, or to transmit malware, spam or content that infringes the rights of others;
• scrape, harvest or place automated load on our systems without our written permission.

5. Your content

You keep ownership of the content you create or upload in an application. You grant us the limited licence needed to host, store, back up, transmit and display that content so that we can operate the service for you. We do not use your content to promote our products without your permission.

6. Our intellectual property

The applications, their source code, designs, trade marks, brand names and this website belong to Bossa Ventures LLC or its licensors. Nothing in these terms transfers any of those rights to you.

7. Availability and changes

We work to keep our applications available and current, and we release updates, fixes and improvements as part of the service. We may add, change or discontinue features. If we discontinue a paid application altogether, we will give account holders reasonable notice by email and refund the unused part of any prepaid period.

8. Suspension and termination

You may stop using the applications and delete your account at any time. We may suspend or terminate access if you materially breach these terms, if payment fails, or if we are required to do so by law. We will give notice where it is practical and lawful to do so.

9. Disclaimers

The applications are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the applications will be uninterrupted or error-free. Our applications are consumer software and are not intended for use where failure could cause death, personal injury, or environmental or financial harm.

10. Limitation of liability

To the extent permitted by law, Bossa Ventures LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total aggregate liability arising out of or relating to these terms is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or fifty United States dollars. Some jurisdictions do not allow these limitations, in which case they apply only to the extent permitted.

11. Indemnity

You agree to indemnify Bossa Ventures LLC against claims, losses and reasonable costs arising from your unlawful use of the applications or your breach of these terms.

12. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. The courts located in Sheridan County, Wyoming have exclusive jurisdiction, except where consumer protection law in your country of residence gives you the right to bring proceedings locally. Before starting formal proceedings, please contact legal@bossa-ventures.com so that we can try to resolve the matter directly.

13. Changes to these terms

We will post any change on this page and update the effective date above. Material changes will be notified to account holders by email or inside the application at least 30 days before they take effect. Continued use after that date means you accept the revised terms.
